NYSBA Supports NAB’s Efforts Regarding Federal Deep Fakes Legislation S.8451

Issues regarding deep fakes have been front and center in New York for some time. Several years ago, New York enacted specific legislation dealing with digital replicas and also digital misrepresentation in the context of political communications.
Our concerns have centered around two issues. We did not want to be held responsible for content received from their parties where we could not determine if a deep fake was included. On the other hand, we want to protect our anchors and talent from inappropriate deep fakes.
This federal legislation, S.4591, addresses both concerns. Moreover, the legislation only preempts state laws that were enacted after January 2, 2025. Most of New York’s digital replica laws were enacted before this date. As a result, New York law will still control.
Nonetheless, NYSBA supported the letter filed by the 50 state broadcast associations, supporting this legislation. You can see the letter here.
The No Fakes Act of 2026 was introduced by Senator Christopher Coons (D. Delaware).
